Prosecutor Jack Smith firmly rebuffed former President Donald Trump’s plea to dismiss charges related to classified documents, emphatically dismissing any parallels drawn to President Joe Biden’s situation.
Trump’s legal team, as reported by Newsweek on Monday, had submitted a complaint asserting unfair targeting in comparison to Biden. However, Smith swiftly countered, labeling Trump’s accusations of vindictive prosecution as baseless.
The crux of the matter lies in the 40 federal charges faced by the former president, encompassing allegations of retaining classified materials and obstructing federal recovery attempts at his Mar-a-Lago resort in Florida.
Despite entering a plea of not guilty, Trump contends that the charges are politically motivated, part of a purported witch hunt aimed at undermining his potential 2024 election bid.
In response to Trump’s claims, Smith’s rebuttal, filed on Monday, criticized the introduction of new factual claims, including references to Special Counsel Robert Hur’s recent report on Biden’s handling of classified documents. Smith argued that such claims should not be raised without giving the government an opportunity to respond.
The prosecutor emphasized Trump’s attempt to draw comparisons between his actions and those of other officials who were not prosecuted, such as Biden, Hillary and Bill Clinton, Mike Pence, and James Comey. Expressing frustration, Smith stated that these legal and factual claims were not part of the original motion and accused Trump’s team of selectively introducing them at this stage.
In a Friday filing, Trump’s legal team sought judicial intervention, alleging ongoing discovery abuses by the Special Counsel’s Office. They argued for the dismissal of Trump’s case on grounds of selective and vindictive prosecution, referencing Special Counsel Robert Hur’s report on Biden’s retention and disclosure of classified materials.
Smith countered these arguments, reiterating that the legal and factual claims were not presented earlier and should not be considered at this stage. He underscored that the defendants had ample opportunity to present these comparisons in their initial motion but chose not to do so.
As the legal battle intensifies, the prosecution remains steadfast in pursuing charges against Trump, vehemently refuting any suggestions of bias or vindictiveness. The courtroom drama continues to unfold, with both sides preparing for a protracted legal skirmish.
