Biden Administration Extends Temporary Legal Status to Thousands of Haitians For a Couple of Years

The Biden administration has announced a significant expansion of Temporary Protected Status (TPS) for Haitians currently residing in the United States, as reported by the Associated Press on June 28, 2024.

The Department of Homeland Security (DHS) revealed that an additional 300,000 Haitians will now be eligible for temporary legal status, citing ongoing violence, instability, and humanitarian challenges in Haiti.

This decision extends TPS for Haitians until February 3, 2026, marking a stark departure from the policies of former President Donald Trump, who aimed to terminate temporary status for several countries, including Haiti.

According to DHS, parts of Haiti continue to experience severe violence and insecurity, with limited access to basic necessities like safety, healthcare, food, and water. The country is also vulnerable to natural disasters such as flooding, mudslides, and storms, exacerbating its humanitarian crisis.

The expanded TPS will benefit approximately 309,000 Haitians already in the U.S. as of June 3, 2023, in addition to around 200,000 Haitians who previously received TPS following the 2010 earthquake and subsequent political turmoil in 2021.

The Biden administration’s decision underscores its commitment to addressing the ongoing humanitarian needs in Haiti, contrasting sharply with the previous administration’s approach. Trump’s efforts to end temporary status for many countries, including Haiti, faced strong opposition from immigrant advocates and lawmakers.

While the expansion of TPS has been welcomed by groups like the Haitian Bridge Alliance, which praised the administration’s action as crucial, concerns remain about ongoing deportations to Haiti for those attempting to enter the U.S. illegally.

Amidst these developments, the Biden administration has temporarily suspended asylum processing for illegal border crossings, aiming to deter unlawful entries. Additionally, the administration has initiated a program allowing up to 30,000 individuals per month from Cuba, Haiti, Nicaragua, and Venezuela to enter the U.S. with financial sponsorship for two years.

As the Biden administration continues to navigate Haiti’s complex challenges, the extension of TPS for Haitians stands as a significant step towards providing temporary relief and protection to vulnerable populations already in the United States.
