President Joe Biden has unveiled sweeping protections for migrant spouses of U.S. citizens, a pivotal move anticipated to impact countless families nationwide, according to a recent report from Fox News.
Set to be enforced by the Department of Homeland Security (DHS), the new regulations will enable specific migrants—including non-citizen spouses and children of U.S. citizens and lawful permanent residents—to seek lawful permanent resident status.
Outlined in a comprehensive plan provided to Fox News Digital, the White House estimates that approximately half a million American families will benefit from these measures. This includes roughly 50,000 individuals under 21 who are either married to or children of U.S. citizens.
Under the updated criteria, spouses of U.S. citizens must have resided in the United States for a minimum of 10 years, maintain legal marriage status with a U.S. citizen, and fulfill other immigration requisites.
Upon approval, eligible individuals can apply for permanent U.S. residency after a three-year period, with provisions for work authorization extending up to three years.
President Biden’s initiative also aims to simplify the visa process for U.S. college graduates, including those covered by the Deferred Action for Childhood Arrivals (DACA) program established during the Obama administration. Graduates from U.S. educational institutions who secure job offers from U.S.-based companies will be allowed to remain in the country.
Clarifying eligibility, a White House spokesperson noted that these policies apply to individuals eligible under existing U.S. law to adjust their status, emphasizing streamlined processes to ensure predictability for those seeking permanent resident status.
While enhancing protections, the Biden administration continues efforts to address border challenges, including plans to bolster resources and collaborate internationally to manage migrant flows into the United States. However, the administration underscores that individuals posing threats to national security or public safety will not qualify for protection under these new rules.
