Tuesday greenlit the progression of a civil lawsuit against former President Donald Trump concerning the demise of Capitol Police officer Brian Sicknick. The ruling, handed down by U.S. District Court Judge Amit Mehta, dismissed two counts, including Garza’s claims of wrongful death and negligence, as reported by CBS. Nevertheless, Mehta granted permission for two counts to proceed under the D.C. Survival Act.
“We are pleased to witness the advancement of our legal action in the pursuit of justice for the late Capitol Police Officer Brian Sicknick, who perished in the aftermath of the January 6th insurrection. We are now weighing our options for the next steps, including the possibility of deposing former President Trump,” remarked Mark Zaid, the attorney representing Sandra Garza.
Sicknick suffered a fatal stroke on January 7, 2021, and the medical examiner attributed the events of the January 6 Capitol riot as a contributing factor to his demise. Subsequently, Sandra Garza, Sicknick’s former girlfriend, initiated legal proceedings against Trump, accusing him of inciting the incident. Additionally, she implicated riot participants George Tanios and Julian Khater, individuals with whom Sicknick had engaged in a struggle at the Capitol.
