The unfolding drama took a new twist with a court hearing scheduled to determine the fate of the subpoena and the subsequent deposition Willis is set to undergo, according to an ABC News report on Monday.

The crux of the matter lies in a subpoena issued to Willis as part of the divorce case involving special prosecutor Nathan Wade. The allegations gain momentum, suggesting a romantic involvement between Willis and Wade during the prosecution of the election interference case against former President Donald Trump.

Seeking to quash the subpoena, Willis contends that her deposition would be “outside the scope of discovery” in the divorce matter, deeming it an “attempt to harass and damage her professional reputation.”

Her attorney asserts, “The sought-after deposition of District Attorney Willis is not relevant to the subject matter involved in the pending action and should not be permitted.”

The controversy gains another layer with timing as it coincides with allegations from Trump co-defendant Michael Roman. Roman contends that Willis and Wade engaged in a personal, romantic relationship, with suggestions of financial gains for both.

The subpoena, served on the same day as these claims, raises questions about the intertwined nature of the legal and personal aspects of this high-profile case.

Wade’s wife, seeking details about the alleged relationship, urges the judge to enforce the subpoena. Supporting evidence includes credit card records indicating Wade’s payments for multiple trips to Miami and San Francisco for both him and Willis during the election probe.

Willis maintains that she “cannot provide unique personal knowledge” relevant to the divorce proceedings due to the marriage being deemed “irretrievably broken.” The filing argues, “Because the parties agree that the marriage is irretrievably broken and the concept of fault is not at issue, there is no information that District Attorney Willis could provide that might prove relevant to granting or denying the divorce.”

Court documents suggest that the relationship between Willis and Wade began “while Wade was married,” prompting his divorce filing “a day after his first contract with Willis commenced.”

The legal battle extends beyond the divorce proceedings, with Ashleigh Merchant, attorney for Roman, seeking to unseal the case. A media coalition, including ABC News, advocates for the unsealing of the case, underscoring the public interest and scrutiny surrounding the allegations.

Since the initial motion containing the allegations surfaced, the DA’s office has maintained a relatively restrained response, stating that they will address the allegations “through appropriate court filings.”

Fani Willis, in her first public acknowledgment of the situation, spoke at a Martin Luther King Jr. Day service, characterizing herself as a “flawed” and “imperfect” person. She defended Wade as a “great friend and a great lawyer” but did not explicitly deny the allegations, alluding to potential racial motivations behind them.

The Fulton County judge overseeing the election interference case has scheduled an evidentiary hearing on the allegations for next month, directing the DA’s office to respond by Feb. 2. Notably, Trump’s attorney is considering adopting Roman’s motion, which seeks Willis’s disqualification from the case and the dismissal of the indictment.
