Former associate White House counsel Jim Schultz, who served under Don McGahn during Donald Trump’s presidency, confidently predicts that Trump’s claim to immunity will face a swift defeat. As reported by Mediaite on January 1, 2024, Schultz expressed his optimism during an appearance on CNN, endorsing Special Counsel Jack Smith’s capability to triumph in the ongoing legal dispute over potential criminal prosecution of Trump for actions taken during his presidency.
Addressing Trump’s immunity assertion, Schultz stated on CNN, “So Jack Smith has a winner on this one, right? I do not believe that the Supreme Court — it is now, the Supreme Court rejected the idea of expediting this. But it still goes to the D.C. Circuit Court, and it’s common knowledge in the legal community, D.C. Circuit Court is kind of the warm-up act for the Supreme Court.” Schultz emphasized the significance of the D.C. Circuit Court, noting that it is often a precursor to Supreme Court decisions, with many Supreme Court justices having previously served on the D.C. Circuit. He anticipates a swift rejection of Trump’s immunity claim by the D.C. Circuit Court.
Trump has consistently asserted on Truth Social, on Christmas Eve, that he cannot be prosecuted for actions taken after the 2020 presidential election, citing his duty as President to investigate alleged election fraud. Contrary to Trump’s stance, Smith contests the idea of broad presidential immunity in a recent filing, arguing that it could shield a president from prosecution for serious offenses. Smith’s examples include accepting bribes, instructing the FBI to plant evidence, ordering the National Guard to harm critics, or selling nuclear secrets to a foreign adversary.
The debate over presidential immunity is central to the broader investigation into Trump’s post-election actions. The Supreme Court’s rejection of Trump’s expedited request has shifted attention to the D.C. Circuit Court, where legal experts anticipate a thorough examination of the immunity claim.
