Federal Case Against Trump Hits Snag as Prosecutors Say The Following On ‘Incomplete’ Witness List

Significant development in the federal case against former President Donald Trump, prosecutors have encountered a hurdle due to incomplete submissions from Trump’s legal team regarding expert witnesses. This delay has prompted prosecutors to request an extension of three weeks to properly prepare their own list of expert witnesses.

Trump is facing a total of 40 federal charges related to alleged mishandling of sensitive materials seized from his Mar-a-Lago estate following his departure from the White House in January 2021. These charges include accusations of obstructing federal efforts to retrieve these materials. Trump has maintained his plea of not guilty to all charges.

According to court filings reported by Newsweek on July 1, 2024, Trump’s lawyers have repeatedly postponed submitting their list of expert witnesses. When they finally submitted the list, it was found to be incomplete. This incomplete submission has compelled prosecutors to seek additional time to ensure they can file their own list in compliance with federal disclosure laws.

Under Rule 16 of federal law, both the defense and prosecution are required to submit their lists of expert witnesses and the specific topics these witnesses will address. These experts are expected to provide insights into the significance of the presidential records discovered at Mar-a-Lago.

Prosecutors stated in their filing to Judge Aileen Cannon that, “The written notice Trump’s counsel has provided the Government is incomplete, and the Government cannot fully supplement its expert notice until Trump files his more fulsome actual Rule 16 disclosures.”

Despite objections from special counsel Jack Smith, Judge Cannon granted Trump’s legal team a third extension to file their expert witness list. However, she emphasized the need for future extension requests to be filed well in advance of deadlines to avoid disruption to the proceedings.

Trump’s attorneys have not contested the extension request filed by prosecutors, indicating a mutual acknowledgment of the need for thorough preparation in this high-profile case.

This delay marks a critical point in the ongoing legal battle, with the next pivotal date set for July 30, when prosecutors aim to submit their completed expert witness list pending Trump’s compliant submission.
