In anticipation of former President Donald Trump’s testimony in his New York civil fraud trial, legal analyst Andrew Weissman discussed the potential tactics the court might witness during an interview with Inside with Jen Psaki host Jen Psaki. With Trump’s appearance in court looming, the key question on everyone’s mind is his best course of action, considering the possibility of invoking the Fifth Amendment.
Weissman, addressing this issue, emphasized that Trump is compelled to appear in court as he has been subpoenaed as a witness. According to Weissman, the strategy adopted by the attorney general’s office would play a pivotal role in determining Trump’s approach.
“There are a lot of aspects they could cross-examine him on, ranging from the size of his apartment to how he valued Mar-a-Lago. These are clear-cut issues where it would be incredibly difficult for him to present a consistent defense without getting entangled,” Weissman explained.
Delving into potential approaches, Weissman elaborated, “Alternatively, the questioning could take a bold turn, probing Trump about the multitude of lies outlined in the D.C. and Florida cases, as highlighted by the government. It’s crucial to note that the attorney general’s office asserts they are dealing with an individual who habitually lies. If the questioning takes a broader scope, Trump might opt to plead the Fifth, especially if the queries directly relate to the pending criminal cases. He could refuse to answer, citing his right against self-incrimination. However, strategically speaking, refusing to respond entirely could prove detrimental. If he chooses not to answer, the court might rule against him solely based on his Fifth Amendment plea, leading to a decisive outcome in the case.”
