The legal battle against ex-President Donald Trump, Judge Tanya Chutkan has made a game-changing decision. She’s presiding over Trump’s federal election interference case and has put the brakes on Trump’s legal team accessing certain top-secret evidence, as reported by Newsweek on November 1, 2023.

This move follows a federal grand jury indictment in August, where Trump was charged with four counts, including a plot to defraud the United States. These charges relate to claims that Trump tried to overturn election results by submitting fake elector slates from states he lost.
The investigation into Trump’s actions has been led by the Department of Justice’s special counsel, Jack Smith. Trump has consistently said he’s innocent and being unfairly targeted for political reasons. He’s pleaded not guilty in this case, as he has in his three other criminal cases.

Judge Chutkan’s decision allows prosecutors to keep certain classified information away from Trump, providing an unclassified summary instead. While the government used the Classified Information Procedures Act and Rule (CIPA) as their reasoning, the specifics of the classified evidence are kept secret.
