Special Counsel Jack Smith seeking to curb former President Donald Trump from making “partisan political attacks,” Trump’s lawyer, Alina Habba, issued a robust rebuttal on Wednesday, December 27.
Habba, speaking on Newsmax’s Greg Kelly Reports, condemned Smith’s action as a “due process violation,” likening it to a “gag order.” She alleged that Smith’s actions stemmed from fear, claiming that “he has no case,” as reported by Newsweek on Thursday, December 28.
Accusing Smith of attempting to suppress the defense’s ability to present its case, Habba drew parallels to prior trials. “He [Smith] doesn’t want any defense being brought by the defense. It is what happened with the last trial I tried, it is what happened with the next trial I try,” she commented.
Highlighting the intent behind Smith’s motion, which urged U.S. District Judge Tanya Chutkan to restrict Trump from asserting victimization through political persecution, Habba expressed concerns about potential prejudice. “They will try and use his [Trump’s] popularity and his voice as a way to work against us and the American people so that people cannot hear the truth,” she cautioned.
Referring to a similar situation in Trump’s civil fraud case in New York, led by State Attorney General Letitia James, where a gag order was imposed, Habba emphasized the restrictive nature of such orders. She pointed out the limitations imposed on her and fellow Trump lawyer Christopher Kise.
Analogizing the situation to silencing opponents in communist states, Habba stated, “I’m a spokeswoman. I’m a lawyer. I am an advocate, and we will handle this like we handle everything else that would be appropriate; with vigor and we’ll take appropriate measures that are in place that we hope will still be in place.”
The charges against Trump in Washington, D.C., stem from his alleged involvement in the January 6, 2021, Capitol riots. They include conspiracy to defraud the United States, obstruction of an official proceeding, attempt to obstruct an official proceeding, and conspiracy against rights. Trump vehemently denies all charges as the legal battle intensifies.
