Former FBI official Andrew McCabe weighed in on Tuesday, December 26, 2023, addressing the intricate legal complexities surrounding Donald Trump’s claim of presidential immunity. Speaking to Raw Story, McCabe highlighted the significance of a potential adverse ruling against Trump at the United States Court of Appeals for the District of Columbia Circuit. He suggested that such a ruling might dissuade the Supreme Court from intervening, potentially easing the Court’s need to address the issue further.
“If the full appeals court aligns with Judge Tanya Chutkan’s stance that the former president isn’t shielded by presidential immunity, it could give the Supreme Court a reason not to step in on Trump’s inevitable appeal,” noted McCabe during an appearance on the Jack: A Special Counsel Podcast.
