Former President Donald Trump faces a challenging forecast ahead of the Supreme Court’s impending ruling, with former White House attorney Ty Cobb predicting a unanimous 9-0 decision against Trump’s claims of immunity from criminal prosecution.

The prediction comes following an appeals court ruling on February 6, 2024, which rejected Trump’s assertions. Cobb asserts that “the president doesn’t have immunity from criminal prosecution,” emphasizing that this argument finds no support in the Constitution.

According to The Hill on February 8, Cobb underscores that the Supreme Court’s resolute dismissal of Trump’s claims could significantly impact the outcome, whether before or after a potential conviction.

Despite the legal and political implications, Cobb outlines a scenario in which Trump, if re-elected before the legal process concludes, might move to halt any ongoing federal case against him preemptively.

Trump vehemently criticizes the appellate court’s decision, arguing on Truth Social that “without Presidential Immunity, the Presidency will lose its power and prestige.” He pledges to appeal the ruling, highlighting the imperative to protect the Presidency and uphold the Constitution.

Amidst a criminal case led by special counsel Jack Smith, accusing Trump of attempting to overturn the 2020 election, Trump’s legal defense relies on three primary arguments, all largely dismissed by the appeals court.

The appeals court panel, including judges nominated by President Biden and former President George H.W. Bush, unequivocally rejects Trump’s immunity claim, affirming that the presidency does not exempt former occupants from the law.

With the case now heading to the Supreme Court, the stakes are high. Tuesday’s ruling challenges Trump to swiftly appeal if he seeks to prolong the underlying case further.

Although the Supreme Court holds a 6-3 conservative majority, legal observers remain doubtful about the prospects of upholding Trump’s immunity claims, given perceived weaknesses in his arguments.
