A recent MSNBC discussion, lead investigator Tim Heaphy drew a striking parallel between one of Donald Trump’s legal arguments and Osama bin Laden’s denial of responsibility for the 9/11 attacks. He highlighted Jack Smith’s filing to limit Trump’s use of irrelevant arguments in his federal election interference case, emphasizing that such attempts to shift blame had been previously unsuccessful.

Heaphy stressed that, similar to U.S. intelligence failures not absolving bin Laden of the 2001 terrorist attack, local law enforcement errors did not excuse Trump from the events at the U.S. Capitol in 2021. He pointed out that while there were law enforcement failures, they did not negate the primary cause of the Capitol attack—President Trump and his co-conspirators.

According to Heaphy, evidence gathered by investigators traced the U.S. Capitol attacks back to a single source—the former president. He argued that the riot was the culmination of a deliberate plan to disrupt a joint session and prevent the transfer of power.

Despite Trump’s not guilty plea to criminal charges, Smith criticized the former president’s attempt to inject partisan political attacks and irrelevant issues into the case. The court filing emphasized the need to prevent the courtroom from becoming a platform for propagating irrelevant disinformation.

In response, Trump accused Smith of leading a political witch hunt, maintaining his innocence in the face of criminal charges.
