The 11th District Court of Appeals dismissed Trump’s claim that his actions were shielded by immunity, asserting that his speech was not invariably an official function. The court cited a U.S. Supreme Court ruling, emphasizing that presidential immunity extends only “no further than the outer perimeter of a President’s official responsibility.”

The court’s decision pertains to multiple lawsuits filed by Capitol police officers and Democratic lawmakers seeking civil damages from Trump in connection with the January 6 riot. This ruling adds to the growing legal challenges faced by the former president, signaling a potential legal crisis.

The rejection by the court comes on the heels of Trump’s disqualification from the 2024 primary ballot in Maine. The state invoked Section 3 of the 14th Amendment, connecting Trump to the events of January 6 and disqualifying him based on his alleged role in the insurrection, following the precedent set by Colorado.

Trump’s efforts to secure immunity faced complications as leaked recordings revealed the extent of his endeavors to overturn the 2020 election results. Former Trump attorney Kenneth Chesebro, part of a plea deal with Fulton County District Attorney Fani Willis, is now obligated to disclose his involvement in schemes, including a fake electors plot and plans to fly fake ballots to Washington, D.C., ahead of Congress’s electoral vote count on January 6, 2021.

The mounting legal challenges underscore the gravity of the situation, with concerns arising about potential Supreme Court involvement.

Former U.S. Attorney Barbara McQuade, commenting on Maine’s secretary of state decision, praised the application of the 14th Amendment and highlighted that the Supreme Court’s stance is not guaranteed, stating, “I think these are challenging questions of law, things that have not really been addressed by the Supreme Court before.”

As Trump faces a complex legal landscape, the court’s firm rejection of his appeal for immunity sets the stage for a critical legal battle ahead. The former president’s actions and statements surrounding January 6 continue to be scrutinized, with legal consequences looming large.
