Former President Donald Trump’s legal team is set to face intense scrutiny as they assert Trump’s immunity against alleged crimes in the U.S. Court of Appeals for the District of Columbia Circuit. This anticipated rigorous examination comes following a Supreme Court decision that returned the matter to the lower court, as reported by Raw Story on Saturday, January 6, 2024.
Conservative attorney George Conway, who attached his name to an amicus brief challenging Trump’s immunity claim, foresees a challenging hearing for the legal team. Appearing on MSNBC with host Katie Phang, Conway shared insights into the significance of the Court of Appeals, which he considers to be the second most important court in the country.
“I think you’re gonna see some intense questioning from the panel,” Conway predicted, emphasizing the panel’s intelligence and capability. According to Conway, the frequency of questions asked during appellate arguments is a crucial factor in predicting the outcome. “Who gets the most questions? There is a 60 or 70 percent chance that person is going to lose, or that their client is going to lose,” he explained.
Anticipating a barrage of inquiries, Conway focused his skepticism on the lawyer representing Donald Trump. “I’m pretty sure the questions are going to be coming fast and furious for the lawyer representing Donald Trump,” he asserted, expressing doubts about the former president’s chances of prevailing in the case.
Furthermore, Conway predicted a swift decision from the Court of Appeals, suggesting that the judges may already be formulating their opinions. “I wouldn’t be surprised to see a quick decision,” he noted, adding that if the Court of Appeals’ opinion is compelling enough, Supreme Court involvement may become unnecessary.
“I think a decision within a matter of days will be in order, and the interesting question will be maybe the Supreme Court doesn’t even have to weigh in if the Court of Appeals’ opinion is sufficiently compelling,” Conway remarked.
As the legal battle unfolds, all eyes are on the Court of Appeals, where the fate of Trump’s immunity claim hangs in the balance. The outcome of this hearing could potentially shape the trajectory of the case, with implications for whether Supreme Court intervention becomes a necessity.
