Response to Donald Trump’s request to postpone his trial regarding the 2020 election and the January 6 attacks, special counsel Jack Smith swiftly countered, asserting that there’s no valid reason to halt proceedings during the appeal.

The Court should not assume at this point that no issue may arise outside the appeal, stated the Justice Department team. Likewise, the defendant’s appeal does not hinder the Court from continuing to enforce protective orders and conditions of release, and progressing with motions already on the docket.

Smith emphasized the government’s commitment to meeting all deadlines to ensure the case stays on course, acknowledging the public’s keen interest. Accordingly, the Government will adhere to the pretrial schedule, providing necessary notices, exhibit lists, motions, and other pleadings related to the trial presentation, even during the appeal process. Any filings made during the appeal can be promptly addressed if the Court’s order is affirmed.

In essence, the Justice Department remains resolute in its stance, unwavering in its determination to move forward with the trial despite the ongoing appeal by the defendant.
