Arkansas Governor Sarah Huckabee Sanders made headlines by announcing the state’s refusal to comply with new federal regulations designed to protect the rights of transgender students in schools.

As reported by ABC News on May 3, 2024, Sanders signed an executive order maintaining restrictions on bathroom and pronoun usage for transgender students, potentially conflicting with the new regulations under Title IX.

Addressing reporters at the state Capitol, Sanders firmly stated, “My message to Joe Biden and the federal government is we will not comply.”

The federal regulation, finalized recently, seeks to clarify Title IX, prohibiting discrimination based on sexual orientation and gender identity in schools receiving federal funding.

Sanders criticized the changes as a reinterpretation of the law, aligning Arkansas with other states like Texas and Oklahoma, instructing schools not to adhere to the new regulation.

Legal challenges against the rule have been filed in multiple federal courts, potentially putting the rule on hold nationwide.

This latest action adds to Arkansas’ measures against transgender rights, including an ongoing appeal against a ban on gender-affirming care for minors and discontinuation of the “X” gender option on state-issued IDs.

Megan Bailey from the ACLU of Arkansas condemned the governor’s actions, calling it a defiance of anti-discrimination laws and an attack on LGBTQ+ freedoms.

Sanders’ order also addresses Arkansas’ law on transgender athletes’ participation in sports teams, with warnings of potential funding loss.

Brandon Wolf from the Human Rights Campaign cautioned about the consequences of non-compliance, highlighting the risk of significant funding reduction.

Sanders, however, expressed readiness to pursue legal action to mitigate any funding losses due to the new regulations.
