In an interview with Breitbart News Daily, Habba contested the ruling, describing it as “not a constitutional decision” and expressed confidence that it would be overturned by the Supreme Court.
The Colorado Supreme Court’s decision, based on Section 3 of the 14th Amendment, invoked Civil War-era legislation to determine that Trump’s actions during the “Stop The Steal” rally on January 6, 2021, amounted to insurrection, rendering him ineligible for public office. Habba alleged a broader agenda, asserting that the decision is part of an effort to obstruct Trump’s political aspirations.
Habba criticized the decision as politically motivated, suggesting that the judges involved were positioning themselves as “pioneers for the liberal radical left” rather than engaging in a genuine constitutional interpretation. She characterized the move as “legal showboating” and warned against overestimating its significance, predicting that the Supreme Court would overturn it.
