Former federal prosecutor Glenn Kirschner has labeled the attempt by former President Donald Trump to hold Special Counsel Jack Smith and fellow prosecutors in contempt as “unbefitting” and “frivolous.” Kirschner, appearing on “The Legal Breakdown” with Bryan Tyler Cohen, expressed disdain for Trump’s legal team’s efforts to persuade U.S. District Judge Tanya Chutkan in Washington, D.C., to hold Smith and two prosecutors in contempt. This move comes in response to the prosecutors turning over extensive discovery materials and providing an exhibit list during a paused case.
Kirschner, in his analysis, highlighted the audacity of Trump’s legal team, stating, “This is so outraged and incensed his defense team that they filed a motion to get the judge to order them to ‘Stop giving us stuff — and by the way judge, we want money sanctions!'” The 15-page document, according to Kirschner, goes to extreme lengths by accusing Smith of attempting to impede Trump’s anticipated return to the presidency.
The document alleges, “…. Prosecutors admitted their goal is to achieve exactly what the stay order forbids — preparing this case for a potential trial, which the prosecutors arrogantly presuppose will occur.” It further claims, “Yet this is not the prosecutors’ only unlawful goal. Unstated but obvious is the prosecutors’ desperate effort to harass President Trump and prevent his likely victory in the 2024 Presidential Election.”
Kirschner, with a wealth of experience having tried hundreds of cases, expressed dismay at the situation, remarking, “This may be one for the record books. It’s one of the most frivolous — it’s a downright silly motion.”
