The decision, handed down by Cook County Circuit Judge Tracie Porter, centers around Trump’s alleged involvement in the Capitol riot of January 6, 2021.

The judge’s ruling sparks a renewed clash in Illinois over Trump’s eligibility for the upcoming election. A group of Illinois voters, supported by advocates nationwide, asserted that Trump should be disqualified based on a violation of a clause in the 14th Amendment to the Constitution.

The contention revolves around the argument that Trump, by participating in the Capitol insurrection, violated a section of the 14th Amendment enacted after the Civil War. This section bars individuals from holding office if they had engaged in insurrection after previously pledging to uphold the Constitution.

While Trump maintains that the amendment does not apply to former presidents, he further argues that even if it does, his actions do not constitute “engaging in insurrection.”
