Wallace’s recent ruling securing Donald Trump’s spot on the Colorado ballot. Despite this temporary win, Katyal warns that the decision may come with significant drawbacks during the appellate process.

Katyal highlighted the complexity of Judge Wallace’s ruling, emphasizing her alignment with petitioners regarding Trump’s involvement in the end-of-term insurrection. However, the narrow interpretation that Trump doesn’t violate the 14th Amendment, as reported by Raw Story on November 20, 2023, could pose challenges in the long run.

Describing the decision as “the very worst” for Trump, Katyal explored potential hurdles in the appeals process, with the case likely advancing to the Colorado Supreme Court and possibly the U.S. Supreme Court.

As an appeals lawyer, if I were to put the headline on Friday, it would be this is the very worst decision Donald Trump could get from the trial court, Katyal stated.

He emphasized the critical nature of the judge’s factual findings, noting that appeals courts typically give substantial deference to trial judges’ determinations, making overturning them nearly impossible.

While you can overturn the legal findings, because that’s basically a fresh look at the legal thing, this judge factually made devastating findings against Trump, Katyal explained.
