Smith plans to present this evidence in Trump’s upcoming trial. The data allegedly depicts Trump’s communication and activity during the Capitol breach. According to Smith’s notice filed on Monday, three expert witnesses will testify about the phone data’s significance.
The first expert will illustrate location history data for Google accounts and devices associated with individuals moving from Trump’s rally at the Ellipse to the Capitol during the riot. Graphical representations will showcase these movements.
The second expert will explain how the location data was gathered by Google and obtained through a search warrant, aiding in understanding the attack’s coordination.
The third expert, accessing cellular phone data from the White House, will testify about Trump’s and another individual’s phone usage, notably identifying periods when Trump’s phone was unlocked with Twitter open on January 6. This data aims to demonstrate Trump’s monitoring of the Capitol situation without intervention.
Smith argues that this evidence supports allegations of Trump’s involvement in interfering with election certification, inciting the attack, and endangering lives. Trump’s lawyers have yet to respond, maintaining his innocence and citing the trial’s constitutionality.
