A recent report by Newsweek, dated December 2, 2023, highlights Attorney Neal Katyal’s assertion that the Supreme Court is likely to reject former President Donald Trump’s contested claims of presidential immunity regarding the U.S. Capitol riot on January 6, 2021.

The Department of Justice indicted Trump in August for his alleged involvement in the Capitol riot during the certification of Joe Biden’s 2020 election win. The riot was fueled by Trump’s unfounded claims of election fraud.

Trump, pleading not guilty to charges including conspiracy and obstruction, insists on political targeting, being a frontrunner for the 2024 Republican presidential nomination.

Katyal, speaking on MSNBC’s The Saturday Show, expressed doubt about the Supreme Court entertaining Trump’s claims, deeming them “bogus” and incompatible with legal scrutiny.

Presidential immunity, Katyal argued, doesn’t shield illegal activities, emphasizing the gravity of the charges against Trump. He predicted a swift rejection by the D.C. Circuit before a possible Supreme Court appeal, which he believes holds little appeal for such bogus arguments.

Trump’s attempt to dismiss the federal lawsuit using presidential immunity suffered setbacks, as noted by Judge Tanya Chutkan, who denied him immunity and emphasized accountability for his actions.

The D.C. Circuit Court of Appeals also dismissed attempts to use presidential immunity to avoid culpability, highlighting the severity of the charges.

Katyal suggested that Trump’s strategy appears focused on delaying the trial scheduled for March 2024, with humorously cynical anticipation of future attempts to postpone it.

Despite Trump’s legal team advocating for presidential immunity, it seems improbable that the Supreme Court will endorse such arguments, given its historical skepticism towards shielding illegal activities.

The unfolding legal proceedings mark a significant challenge to a former president in U.S. history, with potential far-reaching legal and political implications. The emphasis, as per Katyal, is on addressing the serious charges against Trump rather than entertaining claims of immunity.
