Renowned legal analyst Renato Mariotti forecasts a certain defeat for former President Donald Trump in the $250 million New York civil fraud trial, amidst a series of controversial events and judicial interventions.*
In a lawsuit initiated by New York Attorney General Letitia James last year, Trump, his adult sons, and key executives from The Trump Organization are accused of conspiring to inflate Trump’s net worth on financial documents provided to banks and insurers. The alleged objective was to bolster Trump’s financial standing for business deals and loans.
Trump, a prominent candidate for the 2024 Republican presidential nomination, has consistently denied any wrongdoing, dismissing the trial as politically motivated. Despite his combative approach during the trial, marked by attacks on judges and court staff through his social media platform, Truth Social, Mariotti believes an “inevitable defeat” awaits Trump.
The trial took a contentious turn with the imposition of gag orders, restricting Trump’s ability to make inflammatory statements. Judge Arthur Engoron, overseeing the case, levied fines after Trump targeted Engoron’s law clerk, Alison Greenfield, and even took aim at Engoron’s wife, who faced unproven claims posted about the former president. While a state appellate court temporarily froze two gag orders in November, Engoron remains committed to enforcing them rigorously.
Legal experts, including Michael McAuliffe and Glenn Kirschner, have weighed in on the situation. McAuliffe acknowledged the appellate court’s decision and emphasized its potential impact on defendants’ statements, leaving the consequences of any violations uncertain. Kirschner expressed concerns about Trump’s repeated attacks, stressing the responsibility of judges to address potential witness-threatening conduct.
Mariotti, in an interview with MSNBC, described Trump’s strategy as a “long slow defeat,” drawing parallels to a legal concept known as a “slow plea,” where a defendant, anticipating an unfavorable outcome, prolongs legal proceedings as a formality. As Trump continues to challenge the gag orders, the New York civil fraud trial remains a focal point, exemplifying the intricate legal battles and controversies surrounding Trump’s business practices. The reinstated gag orders signal a judicial response to Trump’s provocative statements, paving the way for ongoing legal scrutiny and potential repercussions for the former president.
