Former President Donald Trump has criticized the Department of Justice (DOJ) for its decision not to charge nine officials over classified documents, arguing that he is being unfairly singled out. Trump’s defense team filed a request to dismiss charges against him, citing alleged selective and vindictive prosecution led by special counsel Jack Smith.
The defense pointed out instances involving President Joe Biden and former Vice President Mike Pence, where mishandling of classified material did not lead to similar consequences faced by Trump.
They referenced a report by former special counsel Robert Hur that found Biden to be careless with classified material but noted his cooperation during the investigation. In contrast, Trump’s case was characterized by “serious aggravating facts.”
Trump’s attorneys also highlighted incidents involving other public figures like Bill Clinton, Hillary Clinton, James Comey, and others, arguing that the prosecution’s motives were politically driven.
Judge Aileen Cannon, appointed by Trump, has yet to rule on dismissing the charges based on claims of selective and vindictive prosecution, although she previously denied other requests from Trump earlier this year.
The ongoing legal battle underscores Trump’s stance on his innocence and his pushback against what he perceives as unfair treatment compared to other officials facing similar allegations. The court’s eventual ruling on Trump’s request will determine the trajectory of this high-profile case.
