Former President Donald Trump faced a significant legal setback as a panel of appellate judges unanimously rejected his latest appeal to lift the gag order imposed by Justice Arthur Engoron. The appellate judges, comprising Barbara Kapnick, Kelly O’Neil Levy, Peter Moulton, and Saliann Scarpulla, delivered a four-page ruling emphasizing that the use of such an extraordinary remedy is justified only in the presence of a substantial claim of jurisdictional absence or an act exceeding jurisdiction.
“The gravity of potential harm is small, given that the Gag Order is narrow, limited to prohibiting solely statements regarding the court’s staff,” declared the judges, emphasizing the focused nature of the restrictions aimed at maintaining decorum within the legal proceedings.
The court explicitly stated that a writ of prohibition was not the appropriate means to challenge the gag order and contempt orders. Instead, it suggested that if there were any appealable issues concerning the court’s procedures in imposing financial sanctions, the proper course of action would be to move to vacate the contempt orders and then appeal from the denial of those motions.
