In a report from the Associated Press on Friday, December 22, 2023, a federal judge in Tallahassee heard final arguments in a lawsuit challenging a new Florida law banning transgender minors from accessing gender-affirming health care and imposing restrictions on transgender adults. The law, signed by Governor Ron DeSantis in June, prohibits puberty blockers, hormone therapy, or surgery for transgender youth under 18. It also mandates parental consent and a second opinion from a mental health professional for transgender adults seeking such treatments.

Plaintiffs, including transgender individuals, parents of transgender children, doctors, and advocacy groups, argue that the law violates constitutional rights to privacy, equal protection, and free speech, while harming health and well-being. Defendants, including the state, the Department of Health, and DeSantis, assert the law is necessary to protect children from irreversible and experimental medical interventions.

During the hearing, U.S. District Judge Robert Hinkle questioned the state’s lawyer about the governor’s motives, citing DeSantis spreading misinformation and signing the law on the first day of Pride Month. Hinkle suggested the governor may be pandering to his conservative base as he announced a 2024 presidential bid shortly after. The judge expressed skepticism about the state’s rationale and evidence, indicating a potential inclination to grant a preliminary injunction to block the law or dismiss the case altogether.

Hinkle emphasized concerns about potential irreparable harm to transgender individuals and their fundamental right to make personal decisions about their bodies and identities. He stated he would issue a ruling in the new year, leaning toward granting the injunction and expressing doubt about the state’s likelihood of success on the merits.
