Heartbreaking case that has shaken a California community, authorities say a 26-year-old mother left her young daughter to die in a submerged SUV while she walked away and took a shower. The girl, just 4 years old, drowned after her mother, J. Acosta, crashed her vehicle into an irrigation canal while driving under the influence — with a blood alcohol level nearly three times the legal limit.
The incident happened on the night of March 8. According to investigators, Acosta lost control of her SUV, veering into the canal where the car became partially submerged. Instead of calling for help or trying to save her child, she left the scene and went to her uncle’s nearby house to clean up — leaving little R. Herrin trapped inside the sinking vehicle.
Emergency responders arrived too late. Herrin was found unresponsive and pronounced dead at the scene. The autopsy confirmed that the little girl died from drowning — a death officials say could have been prevented.
What began as a DUI charge has now escalated into a murder case. After a thorough investigation led by the California Highway Patrol and several local agencies, prosecutors upgraded the charges against Acosta. She now faces first-degree murder, vehicular manslaughter, and multiple felony counts. Officials highlighted aggravating factors, including Acosta’s failure to help her daughter and her reckless behavior both before and after the crash.
“This was more than a tragic accident — it was a deadly act of neglect,” said District Attorney J. Laugero, who emphasized the seriousness of Acosta’s actions and the strength of the evidence collected.
Community members have rallied in support of Herrin’s grieving father. A GoFundMe page created to assist with expenses has raised over $22,000. The fundraiser notes, “We pray that justice is served,” reflecting the public’s emotional response to the tragedy.
Acosta is currently being held without bail as the court prepares for what could be a lengthy and intense trial. If convicted on all counts, she could face life in prison.
