Former Trump White House lawyer, Ty Cobb, anticipates a unanimous Supreme Court ruling against the former president regarding his claims of immunity from criminal prosecution. Cobb’s remarks follow a recent appeals court decision that ruled against Trump.
In a report by The Hill on Wednesday, February 7, 2024, Cobb asserted, “The immunity case should be a 9-0 case on the Supreme Court. It is very clear that the president doesn’t have immunity from criminal prosecution. You are weighing an argument that there is no precedent for, and is found nowhere in the Constitution.”
Cobb stressed the significance of the Supreme Court’s decision, suggesting its implications could extend even after a potential conviction of Trump. He highlighted a scenario where Trump could potentially halt any ongoing federal case against him if he were to win the upcoming election before the legal process concludes.
On the other hand, Trump expressed his dissatisfaction with the appellate court’s ruling via Truth Social, arguing that without presidential immunity, the presidency would lose its power and prestige. He pledged to appeal the decision to protect the presidency and the Constitution.
The legal context involves criminal charges against Trump led by special counsel Jack Smith, relating to his actions following the 2020 election and the events surrounding the Capitol riot on January 6, 2021. These charges include conspiracy to defraud the United States and obstruction of an official proceeding.
Trump’s defense team has argued for immunity from prosecution, citing three main points: that his actions constituted official acts, that prosecution would unduly limit future presidents, and that a president cannot be convicted if acquitted by Congress in impeachment proceedings regarding the same conduct. However, the appeals court panel rejected these arguments, stating that the presidency does not shield former occupants indefinitely from the law.
They concluded that Trump’s claim of immunity lacked support from precedent, history, or the Constitution’s text and structure.
With the Supreme Court now at the forefront of the legal battle, observers speculate on the court’s stance despite its conservative majority. Todd Belt, a political management program director, emphasized the potential consequences of a ruling in Trump’s favor, suggesting it could establish presidential impunity akin to a monarchy.
Meanwhile, the political landscape surrounding Trump’s legal battles is evolving, with significant support from GOP primary voters despite his indictments. Diverse perspectives exist regarding the severity and political motivations behind each case, including the Stormy Daniels payment case in New York, the federal case related to January 6, and the Georgia case involving alleged election interference.
