Convicted by a jury in May of the previous year on charges including second-degree murder and violation of constitutional rights, Kapsalis was sentenced following an incident on January 19, 2021. The confrontation between Kapsalis and Tapia escalated after a heated argument, culminating in Kapsalis shouting a racial slur before striking Tapia with his pickup truck as he departed. Tragically, Tapia succumbed to his injuries in a hospital.
Middlesex District Attorney Marian Ryan, addressing the verdict in May, underscored the racial motivation behind the tragedy, stating, “This was a racially motivated, senseless tragedy.” She emphasized Middlesex County’s commitment to prosecuting hate and bigotry as distinct charges, seeking accountability for these aspects of the incident.
Throughout the trial, Kapsalis contended that Tapia’s death was accidental. However, the jury sided with the prosecution’s argument that the act was intentional, propelled by racial animus. The court acknowledged the profound impact of the racial insult on Tapia, describing it as “a horrific racial insult meant to intimidate and threaten him based on the color of his skin.”
In delivering the sentence, Judge David A. Deakin deemed the life sentence commensurate with the gravity of the crime. Despite considering Kapsalis’s support network, the judge highlighted a history of violence, characterizing it as a lifelong pattern. Acknowledging the irreparable loss felt by Tapia’s family, Judge Deakin recognized that no sentence could restore their loved one.
The tragedy has left Tapia’s fiancée and children grappling with the devastating consequences of a senseless act driven by racial hatred. The decision to prosecute hate and bigotry separately underscores a commitment to holding individuals accountable for discriminatory motives.
Kapsalis’s sentencing faced complications as he unsuccessfully sought to reduce his conviction to manslaughter, resulting in a delay in finalizing his punishment.
